\u2026But what happens at the end of the 60 days?<\/strong><\/p>\n\n\n\n

Each time your profile is selected by a brand, the brand must sign the document on “Commitments of Brands or Agencies in the USA” of which here, in italics and in complete transparency, is the current version:<\/p>\n\n\n\n

Commitments of Brands or Agencies in the USA<\/strong>:<\/em><\/p>\n\n\n\n

As Tenants on ConsentPlace profiles with Explicit Consents for use for 60 days, you, the Brand or its Agency (the “Brand”) agree to respect the following principles in accordance with American data protection regulations:<\/em><\/p>\n\n\n\n

1. Compliance with Data Protection Laws<\/em><\/strong><\/p>\n\n\n\n

1.1 The Brand acknowledges that it is responsible for ensuring that the temporary rental and use of user consents comply with all applicable data protection laws, including but not limited to the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA).<\/em><\/p>\n\n\n\n

1.2 The Brand shall not use user consents for any purpose other than the specific purpose and a 60 day duration agreed upon in writing with the Provider.<\/em><\/p>\n\n\n\n

2. Data Security<\/em><\/strong><\/p>\n\n\n\n

2.1 The Brand agrees to implement and maintain appropriate technical and organizational measures to protect the user data rented from the Provider from unauthorized access, disclosure, alteration, or destruction.<\/em><\/p>\n\n\n\n

2.2 The Brand shall promptly notify the Provider of any security breach that may affect the user data, and both parties will cooperate in accordance with legal requirements.<\/em><\/p>\n\n\n\n

3. Data Minimization<\/em><\/strong><\/p>\n\n\n\n

3.1 The Brand commits to collect only the user data necessary for the specified purpose and duration of use.<\/em><\/p>\n\n\n\n

3.2 The Brand will not engage in excessive or unnecessary data collection practices that are not directly relevant to the agreed-upon use.<\/em><\/p>\n\n\n\n

4. Data Retention and Deletion<\/em><\/strong><\/p>\n\n\n\n

4.1 The Brand agrees to automatically delete user data obtained from the Provider after the agreed-upon duration of 60 days has expired.<\/em><\/p>\n\n\n\n

5. User Rights<\/em><\/strong><\/p>\n\n\n\n

5.1 The Brand shall enable and facilitate users’ rights, including the right to access, rectify, and delete their data, in accordance with applicable data protection laws.<\/em><\/p>\n\n\n\n

5.2 The Brand will maintain a designated point of contact for user inquiries related to data protection and privacy.<\/em><\/p>\n\n\n\n

6. Third-Party Compliance<\/em><\/strong><\/p>\n\n\n\n

6.1 The Brand shall ensure that any third parties engaged in the processing of user data for the agreed-upon purpose also adhere to the commitments outlined in this document.<\/em><\/p>\n\n\n\n

6.2 The Brand will establish and maintain contractual agreements with third parties to ensure compliance with data protection standards.<\/em><\/p>\n\n\n\n

7. Regular Audits and Compliance Reviews<\/em><\/strong><\/p>\n\n\n\n

7.1 The Brand commits to conduct regular internal audits to verify compliance with data protection laws and these Commitments.<\/em><\/p>\n\n\n\n

7.2 The Brand shall keep records of audit findings and corrective actions taken.<\/em><\/p>\n\n\n\n

8. Training and Awareness<\/em><\/strong><\/p>\n\n\n\n

8.1 The Brand shall provide appropriate training to its employees and contractors involved in the acquisition and processing of user consents to ensure compliance with data protection laws and these Commitments.<\/em><\/p>\n\n\n\n

9<\/em>. Legal Counsel<\/strong><\/p>\n\n\n\n

9.1 The Brand agrees to consult legal counsel to ensure all data processing activities and practices are compliant with relevant local and international data protection laws.<\/em><\/p>\n\n\n\n

10. User Communication<\/em><\/strong><\/p>\n\n\n\n

10.1 The Brand shall keep users informed of any changes in data processing practices or policies, including any changes in the agreed-upon purpose and duration.<\/em><\/p>\n\n\n\n

10.2 The Brand shall provide clear instructions for users to withdraw their consent or exercise their privacy rights.<\/em><\/p>\n\n\n\n

This “Commitments from Brands or Agencies in the USA” document reflects the mutual commitment of the Brand and the Provider to protect user data, comply with data protection laws, and ensure responsible data processing.<\/em><\/p>\n\n\n\n
